Fighting Demons

Chapter 3

"Now let's move on to the second part of this case. The matter of Joel's
inheritance. Mr. Larson, are you representing Joel and his guardian, Dave
Long?"

"Yes, your honor."

"Mr. Smith, are you representing Mr. Hardin?"

"Yes, your honor."

"I have copies of all the wills, probates and all the legal documents that
have been filed in the county in which you reside, Mr. Hardin. I also have
before me the documents from Mr. Long requesting that he replace Mr. Hardin
as administrator of Joel's trust and inheritance and that Mr. Hardin no
longer to be paid from the trust. In addition, Mr. Long is requesting that
half of Joel's trust be made available to him now. This is not to be paid
all at once. He would like for it to go into another trust that Joel be
able to draw on it now with the approval of this court."

"Mr. Smith, your turn."

"Your Honor, My client request that this petition be denied."

"Why?"

"Mr. Hardin was the person chosen by his in-laws and by his wife to settle
the estate and establish the trust. Therefore, he should be able to
continue being executor. He is the father of Joel . He is the sole
surviving parent and not just a guardian." said Mr. White

"Your Honor, I must agree, Mr. Hardin, is the one chosen to be the executor
and administrator of the estates of Joel's mother and her parents. However,
he should not continue being executor . He forfeited his right when he
abused Joel on several occasions, physically and mentally . He has
threatened to kill him several times and there is not to guarantee that he
won`t try to carry out his threats. Joel could be involved in an accident
or die a natural death. Then Mr. Hardin might try to get the inheritance
claiming that he is the sole surviving parent."

"Your Honor, Mr. Larson is just playing the what `if' games. So far he has
not presented on piece of evidence to support his theory."

"Your Honor, Mr. Smith has presented even less for why Mr. Hardin should
continue receiving money for being the executor."

"I am going to call a recess until in the morning at 9:00 and look at what
has been presented. I will render my decision then. I will see all of you
in the morning."

"Dave, can I talk with you for a few minutes?" asked Rick Hardin so no one
else could not hear. "What happened to our friendship?"

"Absolutely not. You tell me what happened to our friendship. I would say
that you are in deep trouble. I wouldn't tell more lies to cover up
everything. Your lies will trip you up."  *****We were all sitting in the
courtroom waiting for Judge Carol to come in. Rick and his lawyer were
sitting away from the group. There was feeling of tension in the air. The
judge finally came in and the session started.

"I ordered a thorough search of your financial records. We found a large
amount of money that was taken out of Joel's trust fund. The same amount
was deposited in your bank account. I would like to hear your explanation
of this. Mr. Smith, I would like to hear it from Mr. Hardin."

"Certainly. I had the money invested and it was doing poorly. My financial
advisor suggested that I take it out and put in the saving account until we
could find another place in invest it. We were going to try and recover
some of the losses. As you know this was done only three weeks ago. I just
haven't had a chance to reinvest."

"Thank you! I am ordering a very comprehensive examination of your records
and at the same time put a freeze on all you financial assets."

"Joel and Dave, I am going to have everything that you inherited
transferred to a new trust and make Dave administrator of it. I will do the
same to all the real property. Mr. Hardin, you will have 30 days to vacate
the property. You can take any personal property or anything that was not
part of the estate and/ or purchased with estate money. I would also want
you to turn all you account books, deeds and any other documents that are
related to this case to be turned over to this court no later than 15 days
from now."

"Mr. Hardin, I am issuing a restraining order against you. You are not to
make contact with Joel either written or oral. Nor are you to be within ten
blocks of his house or him.  In order words no visiting. This order will
remain in effect for 6 months or until this cases is closed."

"Joel, After 30 days, the house and farm will become yours and you can move
into it, rent it, or even sell it. All the contents, animals, or equipment
are to remain on the property, unless, Mr. Hardin, you can produce bill of
sales for anything that you have purchased with your own money. You can not
count any thing purchased with money paid you by the trust. I hope you have
keep good records."

"Mr. Hardin, Joel and his guardian are not pressing charges against
you. However, I am placing you on probation. Your can not have any contact
with Joel as stated before nor contract with any minor with out an adult
being present. This will be in effect until Joel reaches his 18
birthday. The only exception will be you can have visitation once a month
at the CSD office with Sherri Walker and Dave Long both present that is if
Joel agrees. If you break this probation, you will be facing jail time or
house arrest."

"If there are no more questions, concerns, or comments, then I will declare
case closed. This hearing is adjourned."*****As we were leaving the
courtroom, Rich stopped us and said, "Joel, I hope that some day you can
forgive me. I am going to get counseling and see if I can turn my life
around. I don't like what is going on inside me and I promise I will
change. Thanks Dave for taking my boy off the streets." Tears were rolling
down his cheeks.

A security guard walked up and said, "Sir, the restraining order went into
effect when the judge rapped her gavel.

"I am sorry! Thank you officer." said Mr. Hardin. With that said, we all
continued our exit out of the building. Rich just paused and left after we
did. Nothing more was said.*****Later that day, Joel and I were sitting at
the table enjoying a snack after a trying and exhausting day. "Joel, we
came out better than I thought. I feel sorry for your dad. He really has no
control over his actions and what he says. I certainly hope that he follows
through and gets counseling. I don't think he will survive much longer or
he may do something very drastic."

"I feel the same way. Do you think I could write him a letter and tell him
how I feel and encourage him to go on living and not to give up?"

"Yes, the restraining order is for him not you. There is nothing saying
that you can't contact him. I say write him a letter and I think I will
also. Just letting him know that we are still in his corner and willing to
help him fight his battles, may be enough to let him know that we still
love him and care about him. So let's do it!"

"I am going to write my letter right now," said Joel getting up from the
table and left for his room.

  I went into the den and starting writing my letter. Once I started
writing, I easily wrote 8 pages. At no time did I preach to him. It was all
support and very positive. I ended by saying not to write back. I didn't
want him to get in trouble with court. I suggested that he write to CSD and
Sherri could give his reply to us. If he did write back, he could also put
Joel's letter in with mine. However, I thought that sending it to Sherri
was the best plan and I even enclosed a stamped, addressed envelope.

Joel, came back with more than I had written. He had 12 pages. He wanted to
know if I wanted to read it. "Joel, your letter is personal and just
between you and your dad. In this household, you need and will get your
privacy and personal private time. So I will start right now. Let's just
put you letter in an envelope and seal it. I'll get a large manila envelop
for the den. I think we will need it. I will not intercede unless you
ask. Deal?"

"Sounds good to me!"*****CSD received a letter Joel's dad saying that he
had transferred every thing that belonged to Joel to his trust. He had
rented a U-haul and was moving to California and would start a new life. At
least he knew that Joel had forgiven him and now it was up to him to decide
what to do with his life now.

We decided to make a trip to Joel's home before we decided what we were
going to do. We were leaning toward moving to Joel house. That way he could
continue going to his old school and still have his friends.

We arrive at his house and the hired hand came out to meet us. "Hi, Joel. I
guess you are my boss man now. Your dad said to give you this set of
keys. He had all the locks changed.'

"Thanks, Gerald, You remember Dave, don't you? Where is Tony? Is he still
here or did he leave."

"We both decided to stay. He said he would be around later. Right now he is
in town getting some supplies. Mr. Hardin hired a cleaning crew and the
came in and cleaned the place from top to bottom."

Joel and I entered the house and he froze. "Joel, take some deep breaths
and relax. Are you going to be alright? We don't have to do this you know!"

"I am sorry. I was overwhelmed there for a few seconds. I am ok now."

We took a tour on the inside and we were both pleasantly surprised at the
condition. It appeared that Joel's dad had taken only his clothes and
personal items.

"Well, Guy, What do you think? Do you want to move back?"

"Yes! This is my home. There are a lot of good memories here. I think they
out weigh the bad ones. I am only going to remember the good ones I had
with my mother and father. What are you going to do with your business and
house?"

"Joel, I grew up on a farm and I would love to give it a try again. I could
sell the bicycle shop. I don't have that much invested in it. That little
two bedroom thing I called home will go on the market or I will donate it
to CSD to be use for a half-way house for families. All the furniture and
etc. will go to Salvation Army unless I decide to leave the house
furnished. Why don't we head back. We can stop by the school and pick up
some make up assignments and be back here for you to go to school on
Monday."

"What about the reason that Dad kick me out?"

"What about it. You're 16 and old enough to make your own decisions."

"Thanks, Dave!"

"Not a problem. All I want to say is, Don`t sneak around, What you do in
private is no one's business but your own. I don`t care what two people do
as long as there is no force involved. Of course, you can get a lot of bad
mouthing from some in the community and some of the churches. Just don`t
try to fight back, If it becomes a hate crime, then we will let the law
take care of that part."

On the way out of town we stopped by the high school. The principal was
most cooperative. He even called Gavin to the office.

When he walked in the door, both boys ran to each other and gave a big
hug. Nothing sexual took place. They visited about five minutes and some
one delivered all the make-up from the instructors in charge of all the
classes that Joel had missed. Most of the make-up was mostly reading which
Joel started on the way back to my place.

I called a real estate office and invited them to send a salesperson out
and I would put the bike shop on the market. Joel and I decided that my
small house should be given to be used for a shelter for a homeless
families. The saleslady was going to take care of this for us.

Joel and I went to WalMart and got some boxes. We spent a couple of hours
packing what I wanted to take. .I rented a U-Haul pickup and soon we were
on our way. I drove the U-Haul and Joel drove my car. We drove into the
driveway and unloaded my things.

"Let's take the U-Haul back and turn it in. Then we can go have dinner. It
is late enough to eat. I would like to eat and go to bed we have had a long
day. I think I am getting old. Joel, since this is your town, where would
you like to go to eat?"

"I think I would like to go to Geno's Pizzeria. You won't like it because
it is a hangout for all the kids.""I may be old but certainly not that
old!" I said chuckling.

We arrive at the Pizzeria and went in. Joel was right every kid in town had
to be there. We walked into a large room and Joel was swarmed by all the
kids in town. Joel introduced me to Gavin. "Mr. Long, my mom and dad are
here, would you like to have me introduce them. I know that you would enjoy
them a lot more than a nosy bunch of teenagers!"

"You have that right!" I said. I thought to myself, such a nice level
headed kid. No wonder Joel likes him so much.Gavin took me into a another
room which was filled with adults and little children. He introduced me to
his parents and left to join his friends.

We had a very nice time just visiting and getting to know each other. Sid
and Lois White were absolutely delightful. After a time, Sid said, "Did
Joel tell you about why his dad beat him up?"

"He sure did and came to me for help."

"How do you fell about what they were doing?"

"They know right from wrong. I told him that it was his life and he could
live it the way he wanted to. As long as all of this is consensual and no
force was involved, then I wouldn't get involved. I just didn't want him
sneaking around doing anything."

"That is the same thing that we told Gavin. We may not like what is
happening but at least we still have our son!" Lois said.

"You know this may be just a phase the boys are going through. Tomorrow it
may girls. I think all boys experiment with their friends. Sometimes, I
think this is just one of steps young boys take on their way to manhood. I
know it was for me even when I was in college."

"I would have to agree one hundred percent. I went thought the same thing."

"Men, don't have patient on the rituals of becoming a man. Women have
rituals as well." said Lois. "Some of us grow out of that stage and some
never do."

"Here come the boys. The first thing they are going to ask is, `Can Joel
sleep over tonight`?" laughed Sid. "Might as well get use to it. You'll be
hearing it enough."

"Mom and Dad, can Joel spend the night with us?"

Before they could react, I said, "No, I don't think so. Gotcha!" Lois, Sid,
and I burst out laughing."

"You just wait, Gavin and I will get even. We are like an elephant, and we
never forget!" Joel said and both boys started laughing.

"Why don't, you and Joel plan on going to church with us Sunday. We can
have a barbeque after church and we can go swimming. We have an enclosed
heated pool."

"Sounds like a plan. What time do you want me to pick the kid up?"

"Oh, we'll just have Gavin bring him home."*****

I looked in the phone book to see if an old friend of mine was listed in
it. Sure enough and still at the same address. I thought that I would drop
by and say `Hello'.

I started walking up the steps and I suddenly got a little twinge in my
dick. I rang the doorbell and waited.

"Hey, there Gary. I was in the neighbor hood and thought that I would stop
by and say hi!"

"Sure you were. You just wanted to fuck my ass. I know you! Gee it is good
to see you. I thought that you had dropped on the face of the earth. Come
on in. We have all night to talk."

"So Gary is there a misses or a partner yet?"

"No, I am single."

"What about you?

"The right one hasn't come along yet. I have been searching but found no
one for permanent ties."

Gary came over and threw his arms around me and we started kissing. Soon
our hands were traveling to forbidden places. We both had super hard
stiffs. "Dave, are you up to a little roll in the sack?"

"I thought that you would never ask."

"You know the way to the bedroom!"

"Let's go!"

We took the stairs two at a time and we were naked by the time went through
the door. "I have longed for this for over a year now. Are you still a
total bottom?"

"No, I swing both ways and I like both." replied Gary.

"That sounds like me. I think we are in for fun tonight. I can't stay all
night. I have to go home toward morning and get ready for church.

"Where are you living now?"

"I am Joel Hardin's guardian now and I am living at the Hardin place."

"I heard that the old man got in trouble with the law for abusing his son."

"That he did. He is no longer in the picture and has left town."

"You know that we are wasting a lot of time. Shall we get serious and get
in bed. If we don't I will shoot before long."

"You always did have a hair trigger," I said laughing.
