JUVENILE DETENTION

Chapter 51 – The Notice

Josh had been out of prison for two months before he received three days'
notice of the retrial. David Groggen had phoned him and warned him that he
had pushed for as early a date as possible, saying he felt that Josh needed
his justice in order to get on with his life. David had not told Josh, but
one of the grounds he gave for the retrial to be moved up the court's
calendar was that he needed to be proven innocent before he returned to
school.  A few days after that telephone call Josh got home from a shift at
KFC to find the letter with the trial date waiting for him. At first Josh
was really excited, but shortly that excitement began to turn into
nervousness. Lurking in the back of his mind was the fear that it was all a
whitewash and he would not be given the justice he needed. After all it was
the very institution that owed him that would make the decision.

Simon picked up on Josh's state the moment he got home from school and
asked what the problem was. Josh showed him the letter and said, "I'm
scared."

Simon put his arm around Josh. Sitting down beside him, he reasoned, "Dad
works in this place every day. He believed in your innocence and he
believes it can be put right. He knows what goes on there, and he would not
have tried to get something done if he thought nothing good could come out
of it. I know you have good reason to have doubts about the system, but
trust Dad. He is good."

"Have you ever told your dad you feel this way about him?"

"Don't be stupid. I would have to listen to everything he says then, and
sometimes while I trust him I don't particularly want to listen to what he
says." Simon grinned, knowing Josh would understand exactly where he was
coming from.

"You are a devious guy, aren't you?" Josh responded. "Thank you for helping
me with this. It is silly of me, but I just can't help feeling that if they
have done it to me once, what is there to stop them doing it to me again?"

"Well for one thing you have a smart assed lawyer who believes in you
enough that he is doing this for free instead of the thousands that he
would normally charge. For another you have the sworn statements of the
people you were at the movies with, which can't be ignored. Evidence that
wasn't mentioned at the first trial is already part of the argument that
got you a retrial. And for yet another, you have my dad and not that
arsehole of a step-father behind you."

"Simon, I realise that what you say might be true, but I would thank you
not to use that kind of language in our house." Karl was standing at the
door to the lounge and smiling. "Thank you for the nice thing you said
about me, but what is this all about?"

"Josh has got the notice for the retrial. He's afraid that they will just
shaft him again."

"Josh, it's understandable that you have some doubts. It must be hard to
trust something to put right what they did not seem to care about getting
right in the first place. But believe me, not all the lawyers, barristers
and judges are the same. There are more who want to see what is right done
than there are who just care about getting through the day and getting a
pay cheque at the end of the month.  David is one of those lawyers who will
fight to see justice done, which is why he was the first one I approached
about your case.  You are in good hands, and we will be together through
this whole thing. There are some things you do need to consider and decide
on, though."

"Like what?"

"Do you want to let your mother know about it? For instance."

"No. I will send her a text afterwards to tell her to read the papers and
if it gets into them, then she will know."

"Esther and I have to go out tonight, but if you need us to stay we will
cancel. You are going to win this, and then you will win the other
prosecutions and get your just compensation. I have no doubt whatsoever,
and neither does David Groggen."

"Thank you. You know I have not felt this special since my father died. He
was the only one who really cared about me then. No, you guys go out and
enjoy yourselves. I am just being a bit silly. I will cope and get through
it."

"I know you will. But will you two cope with ordering in take-away?" Karl
laughed as he asked the last question.

"So long as you leave us enough money that if Josh wants something from a
different shop to me we can get it."

"I would have thought that you would be the good host and go along with
whatever Josh wanted."

"Well, we don't want KFC, that I am sure of, so if Josh wants either
Chinese or pizza we will be alright."

"Oh, I haven't had a good Chow Mein since before prison. Can we go for
Chinese please?"

"Chinese it is. How does the idea of Chicken Chow Mein and Beef in Oyster
Sauce with egg fried rice and spring rolls grab you?" Simon asked.

"That sounds great. Do they do sesame toast as well?"

"We'll find out.  Dad are you giving us cash or will it be on your card?"

"If you give me your order now, I will phone and use my card.  What time do
you want it delivered?"

"I'm hungry enough I could eat it now. What time do you want Josh?"

"I'm easy. An early dinner would be okay, so get them to send it as soon as
it's ready?"

Karl took his mobile out of his pocket and went through to the kitchen to
find the shop's flyer with their phone number on it. Simon and Josh could
hear him talking but could not hear exactly what he was saying. When he had
finished Karl came back to the lounge. "Right. All ordered. It should be
here about the time we are leaving. Enjoy it and get yourselves to
bed. Simon, remember you have school in the morning."

"I take it that means you're not expecting to get home till after
midnight?"

"Well, at least not before half eleven. And with the way your mother talks
it will be later than that. So we are trusting you to do what you know is
right."

"Thanks, Dad, but it is rather short notice to organise a party, and I
don't have any beer either."

"Simon Silvey, if we get home and there is even the slightest hint that
there has been any drinking or others visiting I will personally tan your
hide and will keep at it until you are begging me to stop. And I don't care
that you are nearly seventeen.  Maybe I stopped giving you hidings too
soon."

"Aah, Dad, not even a bottle of brandy between us?"

"Not even a sip between you. You know I let you have something on special
occasions, but definitely not on a school night."

"Don't worry, Dad. We will be little cherubs. You will only need to panic
if you see some blue flashing lights as you get home."

"Yeah, right. I'd better go and get ready, or your mum will be ready before
me, and then I will never hear the end of it."

Karl was nearly right. The food arrived five minutes after they had left.
The man who delivered it could hardly speak a word of English, so the boys
signed for the goods and took them inside.  As they unpacked it they
realised there was more than what they were expecting. Simon quickly
checked the slip and saw that his father had ordered an extra dish to
supplement the two the boys thought they were getting so they also had duck
in plum sauce. While the two boys were eating, Simon said, "You know this
is the first time we have been alone at home together for more than about
an hour since you came to stay with us."

"Yeah, I know. It seems a little strange doesn't it?"

"Kind of, but at last we can talk freely without fear of being overheard. I
mean, I don't think mum and dad would purposely eavesdrop on us, but they
might hear something we would rather they didn't."

"True, but then I don't think there is anything that I would want to keep
secret from them. They are really nice people, and I don't have any worries
about them knowing things about me."

"I'm not sure how they would take to the idea that I at least want to
experiment with some gay action and how frustrated I've been not being able
to do that."

"Your folks are pretty cool people. They've had no problem accepting me as
a gay guy into their home. I'm sure they would love you just the same
whether you are gay or straight or something else. Of course they might be
disappointed that they won't get grandkids if you do go the gay route, but
that won't change how they feel about you."

"Do you really think so? I mean, it's one thing to invite a gay boy to come
and stay for a while, but having a gay child is for life."
 "They have loved you since you were just an embryo hanging onto the wall
of your mother's womb. That love has grown stronger with each hour they
have had you. Nothing is going to break that love.  I can see it in the way
your mother looks at you and how she talks about you to others. I could see
it in your father when he was telling me about you in the car on the way to
the Academy eight months ago. And I still see it every time he looks at
you. You could come to them and confess that you are a modern day Jack the
Ripper and still they would love you."

"You really see all that in them?"

"Just as I see it in you. You love your parents very much, and I think you
have absolutely hated being an arsehole, because you could see how it was
disappointing your parents, but you just didn't know how to change."

"But now I've changed. You know I told you there was this guy at school
that was sort of friends with me? Today he asked me if I wanted to go to
his house for a sleepover."

"What did you tell him?"

"I told him I would like to but would have to think about it too, because
that would mean leaving you at home alone. He said to bring you with me,
because he wants to meet you."

"Shit, that is nice of him. But his parents might have something to say
about having a jail bird around for a sleepover. Why not invite him to come
and visit here first? I spoke to the manager at KFC today to ask about the
schedule changes that they've been talking about for weeks, and they are
supposed to be changing next week.  I asked him if he could try and put us
on together as we live at the same place and it would make it easier for
getting to and from work. He said he would do his best, so we might be
getting more time on duty and off duty together."

"That will be cool. I'll put in a similar request when I go to work
tomorrow. You don't mind meeting this guy when you know he is going to be
looking at you a bit sideways and measuring you up as a jailbird?"

"I've already had that experience. If he wants to meet me, he can't be
expecting anything too bad. I guess after the retrial I will have to get
used to it, especially if it gets splashed across the papers, which it most
likely is going to be."

"But then they will know you are innocent."

"Have you heard the saying `no smoke without a fire'?"

"Oh, yeah, I see what you mean. There will always be somebody out there who
will not accept it."

"Unfortunately that's true, and there is not a bit I can do to change it."

"But surely if it gets shown that all the fault lies with the others and
there was nothing you could do about it then they should not think that?"

"They shouldn't, but they will. And then when Sam comes out and I begin to
see him as much as I hope to, they will add that in as further proof. But I
don't give a shit. I love Sam, and we are going to make a life
together. Mark my words on that score."

"Was it hard seeing him this last time and not being able to do anything
with him?"

"Shit! I forgot we hadn't talked about my visit. The first day I was only
able to be there for a couple of hours and we were under the scrutiny of
cameras and kept getting interrupted by others coming in to see me. But the
second day Steven made some arrangements and got Sam and me alone in the
empty sick bay for a few hours. We were naked the whole time and he was
even taken back to his cell block still naked. We got in some good action
and he even got to have the first and probably only warm shower he will
have while inside."

"Warm shower? You mean you pissed on him?"
 "No! That's not my thing at all.  The cell blocks have only cold water
showers, but the sick bay has a warm shower. For some of the patients a
cold shower might make them worse instead of helping them get better."

"Oh, okay, I'm so glad to hear you are not into things like that. I don't
understand people who are."

"Nor do I. Come on, let's get this mess cleaned up, then we can talk about
those things you don't want your folks to hear about. I am a bit curious
what else you might want to talk about like that."

It only took a few minutes for the two boys to clean up, then they walked
through to Josh's room and sat side by side on the bed.

"Fuck the talking. I want to see what it's like to be naked with another
guy and get off with him. Do you think Sam would mind us doing a bit of
stuff together so you can show me what it is like?"

"No, Sam won't mind. In fact he told me he wanted me to help you. He feels
that I'm missing out, now that I can't do stuff with him. The only thing
is, I don't know how I will cope. It should be easier with Sam having given
me his permission, but I still have this silly crazy mixed up head to get
around too. I'm willing to give it a try, but please try and understand if
I find I can't cope with it."

"I'm not too sure how to answer that. I can only say I will try to
understand and hope that I don't feel too frustrated if it happens. Now,
how do we do this?"

"Okay, let's take things a bit slowly at first. So no kissing yet or bj's
or fucking. Let's start by helping to undress each other and then do a bit
of finger exploring and jerk each other off. If we get the chance again, we
can try going a bit further."

Josh pulled Simon towards him and began to undo the buttons on his school
shirt. Simon had removed his tie before he even got home and now just had
his shirt, trousers, socks and boxers on. Josh had less in that he was
commando. Also he had a T on, so there were no buttons to be undone. Josh
tried to make the removal of the shirt as sensuous as possible, pulling the
tails out the front of Simon's trousers slowly, then sliding his hands up
Simon's torso, over his erect nipples, and then over the shoulders, pushing
the shirt off the shoulders and finally sliding the shirt down Simon's
arms. Simon could not suppress a shiver as the palms of Josh's hands slid

would come free when the trousers were removed. As Simon lifted his hands
