LIVES CHANGED

CHAPTER 3-D

"I see, well I guess I should congratulate you on getting two new brothers
also."

"Thank you, sir."

" Now everyone since we have that out of the way I listened to a lot of
things in my life, everything from murder trials to adoptions and this case
leaves me worried about what goes on in the mind of some
people. Mrs. Daniels, I really can't understand you or your lack of respect
for other people. You treat them like they were dirt under your
shoes. Mr. Jefferies you are suppose to be a competent lawyer, though I
know that you are here through legal aid, I find your actions here way
below a first year student. It is my decision that the petition of
incompetency be denied. I find that Malcolm Daniels if very competent and
in full control of his faculties. Mr. Daniels I wish you all the best in
all that you do. Case closed.

"Thank you sir and good luck to you also."

Standing Malcolm made his way slowly up the aisle. "Mr. Daniels."
The judge called out.

"Would you mind if I walked out with you? I would like to meet some of your
friends and your two brothers."

"Sir I would be honored to have you walk with me." The sheriffs opened both
doors so that they could both walk out side by side, when the students saw
Malcolm they all broke out in cheer and applause. Aaron pushed his way
through and ran up jumping at Malcolm. "You done now?" Aaron asked.

"Yes turkey I am." Malcolm said grabbing Aaron around the waist and hugging
him

"Sir this is one of my brothers Aaron, he is six." Malcolm said as he
introduced Aaron.

"Yeah and I am Zeke, and I am eleven, I'm his other brother." Zeke giggled.

"Boys I am proud of both of you, and I am very proud of your big brother
here. I hope that you both grow up to be like him always standing up for
what is right." the Judge spoke.

"Sir these are my friends, my best friend seems to be hiding in the back
there though. Patrick please come up here." Malcolm called out.

The students parted as Patrick was caught flat footed. He wasn't expecting
to be called on like this. "Hi sir, it is nice to meet you." Patrick
mumbled

"Oh really Patrick Adam Jacobs, you act like you have never met me before."
The Judge laughed.

"Sorry sir, but well I didn't want everyone to know you were my uncle."
Patrick stated his face turning red.

"It's okay I won't tell anyone that you have a judge for and uncle." The
judge roared with laughter

"UNCLE that's not fair, Malcolm can I speak to the judge alone for a
second?" Patrick asked.

"Sure, I better take this turkey to the bathroom before he makes a mess."
Malcolm said as he turned and started walking away.

"Thanks." Watching Malcolm and his brother's walk away he turned back. "Are
you coming to his party uncle Jack?" Patrick asked, looking at his uncle
with concern.

"Of course, you don't think I would miss it do you, I mean you did invite
me right?" the Judge replied.

" Yes I did, we got Mike's place doing up the food, and well it was hard
but we did manage to get a permit to have the street shut down so no cars
can come through."

"Does Malcolm know about this?"

"No and nor do his body guards, I kinda forgot to tell them."

"I think you should before they freak out."

"Okay and thanks, I'll see you there then."

Patrick turned and went looking for the two secret service men,
when he found them he told them what was happening. Stan was all for
canceling it when his partner said that it was fine. Then he left Patrick
and Stan standing there glaring at each other. They were still at it when
Malcolm showed up. "Can we get out of here? I have seen enough of this
place for today." Malcolm spoke up.

"Yeah let's hit it." Patrick laughed

"Kid just wait for your car, you know the rules." Stan snapped.

"Yeah I do, so go get it." Malcolm ordered.

"I can't till my partner returns."

"Okay, but I am going outside."

Outside with Aaron still in his arm, Malcolm took a deep breath of
fresh air. Setting Aaron down Malcolm stretched and then reached out to
take Aaron's hand. Stan and his partner were coming and it was time to go
home. The reporters were kept away this time, but Malcolm said that he
would talk with them soon, that right now he just needed some down time. In
the back seat with Zeke and Aaron tight beside him, Patrick was sandwiched
between Stan and his partner was quietly talking.

Malcolm wasn't paying attention so when the car stopped he looked
up. "What are we stopping for guys?"

"Come on Malcolm we're here, lets eat, I'm hungry."

"Okay Turkey, but this isn't home."

"Yeah we know."

"Okay, lets do it then, I need some good food."

"What the hospital food not good enough?" Patrick laughed as he slid out of
the front seat.

Aaron and Zeke both walked beside Malcolm heading over to Mike's
place. Walking in He saw that the place was empty, going to his seat he sat
and wondered what was happening, there was always people in Mike's. Malcolm
could hear Mike in the kitchen banging pots and pans and talking to
himself. Maggie came out with a tray of juice and set it on the
table. "Maggie where is everyone?" Malcolm asked.

"Oh they will be here soon; Mike had to close down for a while."

"I hope it didn't cost him to much, any chance of getting a couple
burgers?"

"Sure, I think."

"Can I have some waffles?" Aaron asked."

"I think your becoming a waffle, turkey, but I guess that will be okay."
Maggie laughed. "What about you two, do you want something to eat also?"

"Sure couple burgers for me" Patrick said.

"Can I have just one please?" Zeke added.

"Okay five burgers and two waffles coming up."

Malcolm was still eating when Mr. Stillman walked in. Seeing
Malcolm he started to walk over, but then stopped and sat at another table,
he didn't want to interrupt the boys as they were eating. Malcolm's dad
soon entered and joined Mr. Stillman and the two men quietly talked. Soon
the place was packed with students and their parents, all there to party
with Malcolm and his friends. People talking quietly, some saw Malcolm
sitting there and waved, others stopped and said hi, but none stayed at the
table.

Out on the street, students and parents were gathering; Malcolm who
was eating really didn't pay attention he was just glad to be eating good
food and being with his friend and brothers. Malcolm's dad finally showed
up and sat with them smiling he ordered a coffee and looked at his oldest
son. "Well Malcolm, how does it feel to be up and about?"

"Good, am glad this one court thing is over, now just to get rid of the
other one."

"Yes, that one shouldn't take to long."

"I hope not."

"Patrick how is your family doing?"

"Good sir, they say hi to all of you"

"How's papa?" Malcolm asked.

"He is doing great. He should be home next week."

"That will be great. I miss him."

"Come on finish up. Zeke can you take Aaron and wash his hands and face,
then meet us at the door"

"Okay pops."

With his dad behind him Malcolm met up with his little brothers at
the door. Patrick was already out side waiting. Stepping out Malcolm
finally noticed the lack of cars and then all the people laughing and
playing in the middle of the road.

Tuesday morning Malcolm was back at the court house this time it
was to deal with the law suit against him. He was hoping that it would be
quick but who knows what would happen. So with his lawyer beside him he
just sat and waited.

The boy's lawyer started talking and talking for over ninety
minutes. Then he called his witness's and for the rest of the day Malcolm
sat there and listened to the boys lie on the stand over and over. When the
court was recessed for the night, Malcolm went over to his sensei and asked
if he could do a work out. "Young Malcolm, you can do that however you must
first sit and meditate, let your anger out."

"That is why I wish to work out."

"Come then I will work with you. I feel that to put a student against you
some one would get hurt."

"Thank you, sensei."

"Remember the tea lilies."

"I try, but some times it is hard to do."

"That is life."

Wednesday morning was spent listening to the Principle and again
Mrs. Rogers. Then it was Malcolm's lawyers turn and by noon it was almost
over there was just the judge's decision. A day and a half of listening to
the lies drove Malcolm mad. At lunch Malcolm just sat alone. He didn't eat
much and by one he was back at the court house. Sitting back at his table
Malcolm wished that it was over and that he could go home and hide for a
week.

The Bailiff had just called the court to order when the Judge
walked in, his robe flowing, but his face showed tightness to it that
Malcolm had never seen before. As the judge sat he looked over at everyone,
then in a harsh voice began. "Gentlemen, never before have I ever listened
to a case that is so full of garbage. First off I can not see how three
senior high football players, can be beaten by an eighth grader. I also do
not understand why your lawyers even considered trying to sue Mr. Daniels,
had your lawyers taken time out to read the transcripts from Mr. Daniels'
trial they would have walked away. It is therefore my judgment that you
three be held in custody on charges of perjury, contempt and assault
causing bodily harm. Furthermore I have issued warrants for the arrest and
detention of Mr. Marshall the principal for perjury and falsifying police
reports and for a Mrs. Rogers for perjury and conspiracy to commit
perjury. I conclude this day by stating firmly that any, and all legal
actions against Mr. Daniels are here by summarily dismissed. With the
slamming of the gavel the case was over. The three boys stated yelling and
swearing at Malcolm as they were led away.

Malcolm just ignored their comments and just headed home. Stripping
down he showered and dressed in jeans and t-shirt. Papa was home and laying
on the couch when Malcolm saw him.

"Papa, you're home!"

"Yes and it is good to be here, I heard you spent a few days there
yourself."

"Yeah, but I am glad your here."

"Well sit down and relax your brothers and dad should be home soon."

"Cool, do you want something to eat?"

"I could do with a light snack."

The rest of the week, and weekend Malcolm relaxed, He helped
Patrick and the others to get the rally set up. Malcolm was hoping that
this would be the last time that they would need to speak to huge
crowds. He wanted to get back into school. The other thing he knew was that
he still had to deal with the President, and he wasn't looking forward to
that.

Monday morning Malcolm was seated with his dad talking quietly,
just enjoying the time with him. "Dad do you ever wish all this had never
started."

"Yes I do, but then if it didn't happen change wouldn't come; sometimes
something small has to happen so that others can be helped. This is a small
change, but look at everyone it is helping."

"I'm trying to."

"Then just do what you have to and soon it will be over."

For the next week Malcolm spent time working with everyone, the
stadium had gotten the sound system working and a stage set up. The rally
wasn't to start till noon on Saturday, and Malcolm was once more the
featured speaker. So on Thursday and Friday he sat in his room working on
his speech trying to make sure that he had everything covered.

Saturday Morning Malcolm woke up at nine, when Aaron came in and
curled up beside him. Opening his eyes Malcolm could see a big smile and
bright eyes staring back at him. "Morning Aaron, what's this." Malcolm
asked.

"Time to get up, pops got breaky ready. Then we gotta go." Aaron giggled.

"Okay, you go tell pops that I will be right down."

"Okies, but hurry up."

"Get going turkey, let me get up and dressed."

The breakfast table was loaded Zeke and Aaron were trying to talk
and eat at the same time, but failing big time. At ten Malcolm was sitting
in the front room as his brothers were upstairs getting dressed his dad and
papa were already dress and waiting. Then it was into the car and off to
the stadium. The best thing for Malcolm was that Stan dropped them all off
right at the gate so there wasn't a long walk for them to go. Malcolm was
left with Patrick and other speakers as the rest went to their seats, all
which were front row. Joining the Jacobs family they sat and
waited. Malcolm could see all the cameras pointed at the stage, a few were
from Florida, and there was CNN and then other TV stations that he didn't
know of. Stan and his partner had walked right out and went over the stage
making sure there was nothing that would cause any damage to Malcolm or the
others that would be seated there.

Five to twelve Patrick walked out to the cheers and whistles of the
crowd. Malcolm couldn't see into the stands but to him it sounded like a
lot of people were there. Right at noon Malcolm heard Patrick start talking
he was followed by others each stating that it was time for a change. At
one thirty Patrick was back on stage. "Ladies and gentleman I know you all
have wanted to hear from our main speaker, and as his friend, I wish you
all to welcome Malcolm Daniels, a great friend and big brother to all who
wish for change.

Malcolm walked out and stopped, gazing around he saw that there
wasn't an empty seat anywhere. Getting onto the stage he stood at the
microphone. "Hi all, looks like I have to sit on the grass." he
started. "When I heard about this rally I was in court fighting another
matter. What got me was that as I was there fighting, my friends had sat
down and drew up a list of changes they would like to see happen within the
school system. I am not talking about school hours or the things we have to
learn, but about the way complaints are handled, the way teachers handle
their students. We all want to be able to keep our individuality, the right
to dress the way we want, within reason. To either have long hair or short
hair. We are asking that the school system take our complaints whether it
is about bullying, the way the teacher has treated a student or other types
of problems that occur. A student should not be condemned for standing up
and saying no to a bully or to a teacher. They shouldn't have to face the
hassles that I have over these last six months.

Parents I know you want your children back in classes, I want to go
back also, I know that this year has been shot to heck, and that we all are
going to have to repeat the year, is it going to make it harder for the
teachers, yes, is it going to be hard for the students, yes again. This all
could have been over and done with within a week if the school board had
listened to us the students, but they refused. They said that we didn't
know what we were talking about. Well six months later they still refuse to
listen even after learning that this strike is no longer just state wide,
but gone nation wide. Students from fifty states are standing behind us.

Does the state government care no, Does the federal government
care. That is hard to say, I know the senate hearing has come out and said
that the system does not need changing. We are gathered here today to show
them all that yes changes have to be made and the time for changes is
here. I was told this week that something small must happen to make a big
change, that small happenings must come so that others can be helped, I
ask, I plead with you all to stand up and help make these changes so that
others may be helped now and in the future.

Thank you all for coming, I pray that what you have heard here
today and in the past as we spoke has gotten through and that you are ready
to say yes to changes and no to bullying. God bless you all and again thank
you for coming out here today."

Finished Malcolm walked off the stage to a standing ovation.
