Subject: Finding Steve Chapter 52

From Last Chapter:

Once Mr. Clark was finished the Judge looked at this watch and stated court
would be in recess until nine o'clock the next morning when Mr. Jones could
call his first witness.  With that he dismissed the jury after he reminded
them that they were not to speak to anyone about the case.  Once the jury
was out of the room he asked the bailiff to remind the witnesses about not
discussing the case with anyone before he released them.  With all of that
said the Judge dismissed court for the day.

Everyone made there way out into the hallway.  We all waited for Brian to
emerge from the witness room.  Once there Mr. Jones asked Brain to be in
his office at eight the next morning to go over his testimony before court,
since he planned to call Brian as his first witness.  Mr. Jones looked over
at Steve and I, and told us that there was no need for us to be there until
court stated at nine.

Steve and I shook hands and said our goodbyes to Brian and his parents
before we headed home.  That night we didn't talk about what happened in
court, except to say that the opening statements were finished and Brain
would be testifying first thing in the morning.  You could tell that the
trial was on everyone's mind.  Even with Aaron over for dinner, it was very
quiet.  Everyone went to bed that night wandering what would happen
tomorrow when Brian would testify.

Chapter 52
**********

Everyone was up early; I made everyone a nice breakfast while they were
getting ready for school.  It was unusual for me to be home in the mornings
during the week, so it was a treat for the boys to have a big, hot
breakfast before school.

Arron arrived just as the boys had finished eating.  He came in and had a
cup of coffee with Steve and I, as the boys finished getting ready to go.
We have come to depend on Aaron to get the boys to school for us.  I told
Steve that we are going to have to do something special for Aaron to repay
him.

Once the boys were off to school, Steve and I got ready so we could make it
to the court house before court convened.  We both wanted to speak with
Brian before he had to testify.  We wanted to give him some reassurance
before court started.

Once court started, the judge reminded those that were to testify that they
were still under oath and that they could not talk to anyone except the
layers about the case.  They were then excused to the witness room while
the jury was brought into the court room.

The judge asked if everyone was ready, and after a short conference with
both sides, the Prosecutor called Brian to the witness stand.  Brian
entered the court room and walked to the witness seat.  Brian was reminded
he was still under oath by the judge before the Prosecutor started.

We could tell that Brian was very nervous.  He was fidgeting in the chair
and refused to look at Dennis.  Brian's eyes stayed right on the
Prosecutor, his parents or Steve and I.

After the Prosecutor got through the normal beginning questions, he asked,
"Brian do you know the defendant sitting here in the court room today"

Brain answered, "Yes I do."

Prosecutor: "How did you first meet the defendant?"

Brian: "I first met him when he approached me one night after football
practice."

Prosecutor: "Can you tell us what happened that night and what you and the
defendant talked about?"

Brain: "I was leaving football practice late, because I had stayed to go
over some new plays with the coaches.  As I was walking to my car in the
student parking lot, the defendant walked up to me, and introduced himself
to me.  He then asked me if I knew a freshman by the name of Colby.  I told
him that I knew of a Colby that was on the swim team and he told me that
was his son.  He then asked if I knew a freshman by the name of Sean who
was also on the swim team.  I told him I knew who he was talking about.  He
then started telling me that Sean's father was living with another guy and
that they were both gay.  He told me that his son, Colby, was hanging
around Sean and he believed that Sean was also gay and was hitting on
Colby."

Brian had to stop and take a couple of deep breaths.  The prosecutor told
Brian to take his time and asked, "What did you think about the defendant
asking you about two freshmen."

Brian continued, "I was a little confused about why he was telling me all
of this, so I asked him why.  He then asked me if I had a little brother.
I told him I did.  He then asked me if I would want my little brother
hanging around some fag that would try and turn him gay, just like Sean was
doing to Colby.  I told him that I wouldn't let that happen."

Prosecutor: "Brian, did at any time during this conversation did the
defendant ever ask you anything."

Brian: "He asked me what I would do to a fag if he tried to turn my little
brother gay.  I told him I would beat the crap out of the guy.  He then
asked me if I would help him take care of the Sean because he thought Sean
was trying to turn Colby gay."

Prosecutor: "Did the defendant ask you to assault Sean that night?"

Brian: "No not that first night."

Prosecutor: "What did the defendant ask you to do that night?"

Brian: "Nothing really.  He said if I was willing to help him he would get
back with me at a later date and we could figure out what to do."

Prosecutor: "Did you and the defendant meet any other times?"

Brian: "Yes.  The next time we met was about a month later."

Prosecutor: "Where did you meet him at?"

Brian: "He asked me to meet him at Bob's Burgers."

Prosecutor: "What did the two of you talk about?"

Brain: "He asked me if I had any classes with Sean.  I told him that I
didn't, but believed that Sean had a class in the same hall that I did."

Prosecutor: "What else did the two of you talk about?"

Brian: "Dennis told me that he had been watching Sean's movements since our
first meeting and noticed that Sean walked from the English hall around the
back side of the gym and seemed to always walk that way alone."

Prosecutor: "Why do you think the defendant told you that?"

Brian: "Dennis told me that while he was watching Sean's movements he saw
Sean talking with my little brother at one of our football games.  He asked
me if my brother was gay."

Prosecutor: "When the defendant told you that, how did that make you feel?"

Brain: "It really pissed me off.  I didn't want no gay guy hanging out with
my brother."

Prosecutor: "What else did the defendant tell you or ask you that night?"

Brian: "Dennis told me that he would feel the same way if a fag was hanging
out with his little brother, or his son, and he would beat the crap out of
the fag if he could without getting caught.  Then he asked me if I ever
walked behind the gym."

Prosecutor: "Do you normally take that short cut behind the gym back to the
main building?"

Brian: "I have before but normally I don't.  My next class is easy to get
to from the hallway."

Prosecutor: "Did the defendant ask you to do anything for him that night?"

Brian: "Yes."

Prosecutor: "What did the defendant ask you to do?"

Brian: "Dennis asked me if I would take care of Sean for him."

Prosecutor: "Did you ask the defendant what he meant by that?"

Brian: "Yes."

Prosecutor: "And what did the defendant say"

Brian: "Dennis told me that he saw Sean talking with my little brother at
our last couple of football games, and thought Sean may be hitting on him.
Dennis said Sean needed to be taught a lesson, and needed his ass kicked so
he would stop hitting on Sean and my little brother.  Dennis told me that
he knew Sean used the short cut behind the gym after his fourth period
class and was always alone.  Dennis told me that would be the perfect time
to show him that he can't turn Colby and my little brother gay."

Prosecutor: "Did the defendant give you any instructions?"

Brian: "Yes, Dennis told me I should wait for Sean behind the gym and teach
him a lesson by kicking his ass real good."

Prosecutor: "Did the defendant give you any specific instructions on how
you were to teach Sean a lesson or how to assault Sean?"

Brian: "No not really.  Dennis just told me to make sure that Sean didn't
see me as he came around the end of the gym wall so Sean would not be able
to identify me as his assailant, and to make sure that I taught him a good
lesson."

Prosecutor: "What do you think the defendant meant by that?"

Brain: "To beat the hell out of Sean."

Prosecutor: "Did you and defendant talk about anything else that night?"

Brian: "No not really.  Other than Dennis wanting me to beat Sean up as
soon as possible that was about it and then Dennis left."

Prosecutor: "Did you have any other discussion with the defendant before
the assault on Sean took place?"

Brian: "No sir."

Prosecutor: "Did you do as the defendant ask, and lay in wait for Sean to
assault Sean?"

Brian hung his head in shame as he answered, "Yes sir, I did."

Prosecutor: "Can you tell us what happened the day of the assault?"

Brian: "I told my teacher that I needed to use the bathroom and left class
early.  I then went to the back of they gym and waited for Sean, knowing he
would likely walk to his next class by taking the short cut as Dennis had
told me.  I could see the door way that Sean would come out of from where I
was waiting.  I saw that he was walking alone so I stood against the wall
out of sight.  As Sean came around the corner, I punched him in the side of
the head.  Sean fell to the ground and I then kicked him several times."

When Brian finished and looked back up you could see the tears rolling down
both cheeks.  You could see that he was truly ashamed for what he had did
to Sean.

Prosecutor: "Then what did you do?"

Brian: "I walked off, toward the student parking lot, got into my car and
left, going home."

Prosecutor: "Did you at anytime after assaulting Sean, speak with the
defendant again?"

Brian: "Yes sir, just once.  Dennis had given my his number and ask that I
text him after I taught Sean a lesson.  So once I got home I text Dennis
and told him I had did it."

Prosecutor: "Did you have any contact with the defendant after that?"

Brian: "Yes.  I saw him in the student parking lot one night after football
practice.  Dennis was sitting in his car and motioned for me to come over.
He then told me that I had did a good job and told me about Sean's
injuries.  I noticed that Dennis was smiling as he told me and then he just
gave be the thumbs up, thanking me, and gave me an envelope before driving
off.  I never saw or spoke to him again until now."

Prosecutor: "What was in the envelope that the defendant gave you that
evening?"

Brian: "Cash.  Two hundred dollars in cash. Dennis told me he would give me
the two hundred dollars for assaulting Sean."

The prosecutor thanked Brian and then stated he didn't have any more
questions for him.  The judge looked at his watch and then said, "I think
this will be a good place to break for lunch.  We will start back up at 1pm
with cross exam."

The judge looked over at Brian and reminded him, "Son don't forget you are
not to speak to anyone about your testimony or this case other than with
attorney's."  With that he banged his gavel and said, "Court stands in
recess until 1pm."

Steve and I stood and waited for the jury and the judge to leave.  I turned
to Brian's parents and asked if they and Brian would like to join Steve and
I for lunch.  They liked the idea but when Brian walked up he told his
parents that he needed to meet with the prosecutor during lunch to prepare
for the cross exam.  Brian's mother asked what he was going to do for lunch
and Brian told her the prosecutor said he would have lunch delivered for
the two of them.

Brian walked off with the prosecutor as his parents walked out with Steve
and I.
